Refund Policy for Echowave Digital LLC

1. Our Commitment & The Nature of Our Digital Services

Echowave Digital LLC (“Echowave LLC,” “Echowave Digital,” “we,” “us,” or “our”), located at 1281 RIDGE AVE, LANCASTER, WI 53813, USA, is dedicated to providing high-quality online business consultancy, branding, marketing, web and app development, and other digital services (“Services”). These Services involve significant creative and intellectual effort, strategic planning, professional time, resource allocation, and often, non-recoverable third-party costs.

Due to the nature of these Services and the resources committed upon engagement, Echowave Digital LLC generally operates under a non-refundable policy for fees paid for Services rendered or resources committed. By engaging our Services and making payment, you (“Client,” “you,” or “your”) acknowledge and agree to this Refund Policy. This policy should be read in conjunction with your specific Service Agreement (e.g., Project Proposal, Statement of Work) and our Terms of Service.

2. Non-Refundable Fees and Costs

The following outlines our policy regarding different types of fees and costs:

  • Consultancy & Strategy Fees: Fees for strategic consultancy, business analysis, planning sessions, and advisory services are based on professional time and expertise provided and are considered earned as the work is performed. These fees are non-refundable.
  • Branding & Creative Design Services: Fees for branding, logo design, graphic design, content creation, and other creative services often involve initial deposits and milestone payments. Once work has commenced, conceptual designs have been presented, or deliverables provided as per the agreed scope, these fees are non-refundable.
  • Web & App Development Services: Fees for website and mobile application design and development are typically structured with deposits and milestone payments. Payments for completed milestones (e.g., design approval, development phase completion, testing phase completion) are non-refundable. Project initiation deposits are also generally non-refundable as they cover initial resource allocation and project setup.
  • Digital Marketing & Advertising Services:
    • Service/Management Fees: Monthly retainers or fees for managing digital marketing campaigns (SEO, SEM/PPC, social media marketing, content marketing, email marketing, etc.) cover the ongoing work, expertise, and resources allocated for that service period. These fees are non-refundable once the service period has begun.
    • Setup Fees: Any one-time setup fees for marketing campaigns or accounts are non-refundable.
  • Hourly Work: Any services provided and billed on an hourly basis are non-refundable for hours already worked.

3. Third-Party Costs

Funds allocated for or paid to third parties on your behalf are strictly non-refundable by Echowave Digital LLC. This includes, but is not limited to:

  • Advertising spend (e.g., Google Ads, Meta Ads, LinkedIn Ads).
  • Fees for stock photography, videography, or other licensed media.
  • Costs for premium themes, plugins, or third-party software licenses.
  • Printing and production costs.
  • Domain name registration and website hosting fees (if managed by us but paid to third-party providers). These costs are subject to the refund policies of the respective third-party vendors.

4. No Guarantee of Specific Results

As outlined in our Terms of Service, Echowave Digital LLC does not guarantee specific outcomes or results from our Services (e.g., specific search engine rankings, website traffic levels, conversion rates, sales figures, lead generation numbers, or market share). Our fees are for the provision of professional services, expertise, and effort. Dissatisfaction with specific metrics or outcomes, where services have been performed with professional diligence as agreed, is not grounds for a refund.

5. Service Cancellation by Client

If you choose to cancel your Services with Echowave Digital LLC, you must do so in accordance with the termination clause in your Service Agreement or our Terms of Service. Upon cancellation:

  • You will be responsible for payment of all fees for work performed by Echowave Digital LLC and for all non-cancellable costs and expenses incurred up to the effective date of termination.
  • No refunds will be issued for any payments already made for work completed, resources allocated, or costs incurred prior to the cancellation date.
  • Any outstanding invoices must be paid in full.

6. Project Abandonment

If a Client fails to respond to communications or provide necessary feedback/materials for a period of [e.g., 30 or 60] days without prior notice, Echowave Digital LLC may, at its discretion, consider the project abandoned. In such cases, any fees paid to date may be forfeited and considered non-refundable.

7. Exceptional Circumstances & Discretionary Considerations

While our policy is generally non-refundable for earned fees and incurred costs, Echowave Digital LLC values its client relationships. In truly exceptional and documented circumstances where there has been a clear, demonstrable, and material failure on our part to deliver a core component of the agreed-upon Services as outlined in the Service Agreement (and such failure is not attributable to Client actions, inactions, changes in scope, or external factors beyond our reasonable control), Echowave Digital LLC may, at its sole and absolute discretion, consider a partial refund or a service credit for future work.

Any request for such consideration must be made in writing, detailing the specific grounds, and will be reviewed on a case-by-case basis. This provision does not establish any right to a refund but allows for discretionary review in unique situations.

8. Billing Disputes
